Waiter convicted of murdering baby given legal aid for appeal

A WAITER convicted of killing his baby stepson has been granted legal aid in a bid to clear his name.

Mohammed Ullah was jailed for life and ordered to serve at least 13 years behind bars after he was convicted of murdering nine-month-old Kyle Mutch, following a trial at the High Court in Forfar in September 2004.

The baby died as a result of massive internal injuries. A pathologist told the High Court the child's wounds were the worst he had seen in 25 years.

Ullah, 30, of Knockie Road, Turriff, Aberdeenshire, has always maintained his innocence and had blamed the boy's grandmother, Marlane Low, 60, for the Kyle's death in January 2004.

The conviction of the Bangladeshi-born waiter has recently been challenged by pathologist Dr Glyn Waters, who stated that Kyle may have been injured as the result of an accident, possibly with another child.

The Scottish Miscarriages of Justice Organisation has now confirmed that Ullah has secured legal funding to enable him to launch an appeal.
