Man faces jail over sex act on Dundee bus

Barrie Falconer pleaded guilty to “committing an offence of public indecency” on a number 18 bus en route from Old Glamis Road to the city centre.

But his alleged partner in the crime, Rhia Rodgers, had her not guilty plea to “participating in oral sex on said bus” accepted by prosecutors.

A court source said: “That’s certainly raised a few eyebrows around here - surely it takes two to tango?”

Rodgers instead admitted a charge of stealing three sex books from an Ann Summers store in Dundee’s Reform Street two days after the bus romp.

Dundee Sheriff Court earlier heard that children as young as 12 had been on the bus and were to give evidence against Falconer and Rodgers at a trial.

But Falconer pled guilty today minutes before his trial was due to begin.

His case was continued until next month for social workers to compile background reports on him.

Books stolen

Fiscal depute Douglas Wiseman, detailing the theft charge against Rodgers, told the court: “The value of the books was £20.97.

“At the rear of the store books are displayed, partially hidden by a screen.

“The accused entered the shop and made her way to that area.

“She then left the store.

“Staff checked CCTV and saw the accused pick up three books and walk out with them without paying.

“They were later recovered by police.”

Indecency

Falconer, 35, of Tullideph Road, Dundee, pleaded guilty on summary complaint to a charge of public indecency committed on June 12 this year.

Rodgers, 22, of Andersons Lane, Dundee, had her not guilty plea to the same charge accepted by the Crown.

She pleaded guilty to a separate charge of stealing a quantity of books from Ann Summers, Reform Street, Dundee, on June 14 this year.

The charge states that Falconer “committed an offence of public indecency” on the number 18 Travel Dundee bus en route from Old Glamis Road in Dundee to the city centre by participating in oral sex on said bus.

Ian Myles, for Rodgers, said she is currently pregnant and had no other cases against her outstanding.

Sheriff Richard Davidson deferred sentence on Falconer until December for background reports to be prepared.

He deferred sentence on Rodgers until May next year for good behaviour.

Neither of the pair commented on the case as they left court today.
