Pub shooting victim's brother is jailed over vicious assault

THE brother of an ex-boxer who was shot and stabbed in an attack at the Jock's Lodge pub has been jailed for 16 months after beating a man unconscious.

Terence Carlin was caught on CCTV repeatedly punching, kicking and stamping on Scott Penman's head and body on a garage forecourt.

Yesterday, the 21-year-old was jailed for 16 months at Edinburgh Sheriff Court after pleading guilty to the attack and asking to be sent to jail.

Carlin is the younger brother of James Carlin, 24, who was shot in the leg with a firearm before being stabbed in the upper leg area in the pub gun attack on Sunday, 7 March.

Two men have been arrested and charged over the incident.

Before yesterday's sentencing, Terence Carlin had already received separate jail terms for assault and possession of an offensive weapon.

Sheriff Kathrine Mackie told him yesterday: "There can be no doubt this is a very serious matter. To punch and kick someone on the head and to stamp on the head could result in very serious injury and could be fatal."

Fiscal depute Melanie Ward told the court Carlin and Mr Penman had been speaking at the Shell Garage forecourt in Edinburgh Road, Musselburgh, on 1 February last year.

She said: "Without provocation Carlin repeatedly began to strike Mr Penman on the head and body by punching him, which caused him to be knocked to the ground. Then when he had fallen to the ground the assault continued and he was then repeatedly kicked and punched on the head and body and witnesses, including a private hire taxi driver, saw he was then stamped on repeatedly on the head and body and he was prevented from getting to his feet.

"He was punched on the head again and was rendered unconscious. The accused then walked away from the incident and made off in a taxi."

The court heard Mr Penman discharged himself from hospital before he was fully examined, but was suffering from a suspected broken nose.

He also had shoe imprints on his hands, cuts to his face and was bleeding from his left ear.

Defence agent Vincent Belmonte said Carlin, of Hay Gardens, Craigmillar, wanted custody to be imposed as he had a severe alcohol problem which was at the root of his offending.

He said: "He thinks a spell in custody would assist him in staying away from alcohol."

Sheriff Mackie said she had reduced Carlin's sentence from two years to reflect his guilty plea.

In February, Carlin was jailed for a year for beating up a shopkeeper's brother outside a store in Hay Drive, Craigmillar, last October.

His co-accused, Ryan Moore, 22, also received a year's imprisonment for launching an assault on shopkeeper Bajinder Bajwa, stamping on his head after knocking him to the ground.

Mr Bajwa's brother, Kawaldeep, tried to stop the attack and was assaulted by Carlin, who later returned to the shop and threatened to kill the brothers if they told police.

Following the Jock's Lodge shooting, Dean Scott, 27, appeared in court last Wednesday to face charges of assault with intent to murder and attempted murder. He was also accused of an offence under the Firearms Act 1968.

The following day, David Coutts, 20, appeared in court charged with assault with intent to murder. Both men made no plea and were remanded in custody.
