Old Firm star faces retrial

Celtic star Georgios Samaras is heading back to the dock after appeal judges ruled yesterday that he should not have been acquitted of using a mobile phone while driving.

The Greece international stood trial at Glasgow's justice of the peace court, accused of using the phone in his Volkswagen Golf car in the city's Greendyke Street on 10 January, 2009.

After evidence from two policemen, Samaras's lawyer argued that there was no case to answer, and the court agreed and found the player not guilty. The court believed there was insufficient evidence the phone had been "used".

The Crown appealed the decision, and the Justiciary Appeal Court in Edinburgh was told that Samaras did not now dispute that the justice of the peace had been wrong.

Lord Bonomy, sitting with Lords Bracadale and Wheatley, said there was sufficient evidence and the trial will be resumed.
