Man cleared of rape back in the dock

A VICTIM of a miscarriage of justice who was jailed for six years for raping a schoolgirl has been convicted of a breach of the peace.

Desmond Uttley was found guilty after a trial held at Edinburgh Sheriff Court yesterday following an altercation with a security guard.

The 38-year-old, from Hailesland Park, Wester Hailes, was arrested following an incident at the Scotmid in Gorgie Road on July 20 last year.

But Uttley was cleared of acting in a racially aggressive manner towards security guard Solman Nkanshah-Dwamena.

Mr Nkanshah-Dwamena gave evidence that Uttley called him a “black b******” after he refused to keep watch on his bull mastiff while he shopped.

But Sheriff Kathrine Mackie found unemployed Uttley guilty of a breach of the peace and fined him £400.

The former barber was jailed in November 2002 after being found guilty of raping a 15-year-old girl in Lochend Gardens. He was freed in 2004 pending an appeal before his conviction was quashed in 2009.
