AT THE time of the killing of Reamonn Gormley, Daryn Maxwell was on bail, which was granted at the High Court on 7 January this year.

He had pled guilty to stabbing Craig Fellows three times on the body to his severe injury on 30 August, 2008, at Stonefield Road, Blantyre.

On 23 July, 2009 Maxwell was sentenced to 32 months’ detention.

An appeal against sentence was lodged on 31 December last year and he was granted interim liberation on 7 January pending the outcome of the appeal.

The original sentence was quashed on the grounds it was incompetent and the Appeal Court substituted a sentence of 32 months to date from July 2009.

Maxwell’s criminal record began in 29 May, 2003, when he was convicted at Hamilton Sheriff Court of assault to severe injury and permanent disfigurement. The case was deferred to the Children’s Panel.

On December 2004 at Hamilton Sheriff Court, he was sentenced to four months’ detention for breach of the peace and having an offensive weapon – a piece of wood.

Between 19 April, 2005, and 27 May, 2005, he made a number of appearances at Hamilton Sheriff Court for breach of the peace and contraventions of the Criminal Procedure Act 1995. This resulted in a probation order of 18 months combined with a restriction of liberty order.

In June 2005, he appeared at Hamilton Sheriff Court for breach of a probation order and on 26 January, 2006, he appeared at Lanark Sheriff Court on a charge of wilful fireraising and was sentenced to 20 months’ detention.

In June 2006 he again appeared at Hamilton Sheriff Court, on a charge of assault to severe injury, and was sentenced to 18 months’ detention.

In addition, Maxwell has a number of convictions for breach of bail offences.
