E-Clear was sued before collapse

CARD payment firm E-Clear may have been trading insolvently, after it emerged a Canadian tour operator successfully sued the firm for non-payment of £46 million eight months before it collapsed.

Toronto-based Sunwing found E-Clear did not have the money it was owed and decided to wait and see if it would be able to return the money later.

If E-Clear was trading insolvently it could give rise to civil law suits. E-Clear collapsed in January after administrators for failed airline Flyglobespan took it to court over the non-payment of 35m.
