The judges, including Lord Carloway, had heard submissions from Mr Withey and Mr Grier’s legal teams.

The reasons for the judges’ decision cannot be reported at this point in time for legal reasons.

Prosecutors had alleged that Mr Withey, Mr Grier and Mr Whyte participated in criminal behaviour during their involvement with the Glasgow side.

Mr Whyte was in charge when the clubs’ previous incarnation went into administration in February 2012.

He was also in charge when the side was liquidated in July 2012. The case is next scheduled to call at the High Court in Glasgow on 3 June.

Mr Grier worked for the financial company which was appointed as administrators of Rangers while Mr Withey was a former partner at the London-based law firm that advised Mr Whyte during his takeover.
