The Court of Appeal said Jamaican Rhomaine Mohan, 32, would be “disadvantaged” in a battle for custody of one of the three daughters he has fathered while in Britain if he was forced to leave. Three appeal judges concluded that Mr Mohan, who had been removed to Jamaica in 2006 but returned three months later using a false passport, should be allowed to continue to fight to stay in Britain.

They upheld an appeal by Mr Mohan – who argued that his human right to family life was being undermined – against the latest ruling and ordered the tribunal to reconsider his case.
