Hide AdMs Green’s $27.5m (£16.7m) claim states the driver’s taxi licence should have been suspended before the accident as he had a record of past driving violations.
The city’s Taxi and Limousine Commission has cited a now-fixed computer problem with allowing the taxi driver, Mohammed Fasyal Himon, to continue working.
Himon has said the accident was not his fault. New York’s Law Department says it will review the claim.
