A sound defence?

THIS latest case raises interesting questions over when it is appropriate to defend yourself or your property – and how far you can go.

James Chalmers, senior lecturer in law at Edinburgh University explained where the law stands. He said: “You can use force as a last resort to remove a trespasser or in this case a shoplifter. You must first have asked them to leave though.

“In a case of self-defence you are allowed to protect yourself. It is easier in law though to explain defending yourself than it is to explain defending your property.

“It is at the discretion of the courts as to whether blame lies with any party.”
