Rapist told woman ‘I’ll prove I’m not gay’

A RAPIST told a visitor to his home that he would prove he was not gay before attacking her.

John Docherty’s victim repeatedly pleaded with him to stop during the attack but was subjected to a series of sex acts.

Docherty, 42, who ran a motor valet business at the time, had denied raping the woman in a house at Queens Crescent, Livingston, in West Lothian, on August 6, 2010. But a jury at the High Court in Edinburgh unanimously convicted him.

The 26-year-old mother-of-two told the court that on the night of the attack when she arrived at Docherty’s then home other friends of his were there having a drink.

She’d had a couple of drinks earlier and poured a glass of wine, but the others left. She said she was “tipsy” but Docherty appeared drunk.

She said after the others left she was trying to have a conversation but Docherty was being “slightly hostile”.

“He kept saying ‘You think I am gay. I will prove I’m not’,” she said.

Jailing him for six years, judge Lord Bracadale told Docherty: “She made it clear that she was not consenting to have sexual intercourse with you. You persisted despite her repeated requests for you to stop and resorted to force.”

Docherty was also placed on the sex offenders register.
