Rapist told his victim before attacking her: ‘I’ll prove I am not gay’

A MAN who told a woman he would prove he was not gay, and raped her, was jailed for six years yesterday.

John Docherty, 42, claimed the woman consented to sex with him, but a jury convicted him unanimously of a rape charge.

The High Court in Edinburgh heard the woman, 26, a mother of two, had been drinking with friends in Docherty’s home in Livingston, West Lothian, on 6 August, 2010.

She said the others left, and she was “tipsy” and Docherty was drunk and became hostile. “He kept saying: ‘You think I’m gay. I’ll prove I’m not,’” she added. Docherty pushed the woman into a bedroom and attacked her.

The judge, Lord Bracadale, told Docherty: “She made it clear she was not consenting… you persisted despite her repeated requests for you to stop and resorted to force to overcome her will. It is clear from the victim impact statement that this has had a profound effect on her life.”
