Public may be obliged to clear snow from their properties

MEMBERS of the public could become legally obliged to clear snow from outside their properties, after city leaders agreed to look at introducing a by-law making them responsible.

Administration councillors have accepted a call from opposition councillor Andrew Burns to look to introduce a by-law forcing residents and business owners to clear the front of their properties during winter weather.

It could theoretically mean that property owners could be taken to court if someone is injured outside their property when they have not made it safe.

Council officials have also been asked to assess any implications that may come from introducing measures to ensure residents and businesses are responsible for clearing snow outside their properties.

Councillor Robert Aldridge, the city's environment leader, said: "I know that a number of people have felt uncertain about whether they should clear the path outside their house. We know that we need the help of local citizens and need to make it clear that people have a duty to clear their paths."

When asked what would happen if the by-law is introduced but people do not clear their paths, Cllr Aldridge said: "In theory, we could take some action, but it is more about people knowing they have a duty to clear the path outside their home.

"It is a moral pressure we are putting on people but we do not envisage taking people to through the courts. It is more making it clear that people need to help themselves and their neighbours."

Officials are also to detail what measures can be used to help the council remove cars that have been abandoned because of snow, creating obstacles for gritters and emergency services.
