Letter: EU and Scots law

Michael Hamilton (Letters, 16 December) suggests that, lacking a written constitution, Scotland might drift on, hoping that Brussels and Westminster might govern us better.

This notion begs the question whether Brussels has any right to enact legislation which can legally be incorporated into Scots law.

Since the people of Scotland have never been given the opportunity in a referendum to vote on whether we should become a member state in the European Economic Community, there is no democratic foundation for the automatic incorporation of EU regulations formulated in Brussels into Scots law.
