Man jailed over baby’s death set for case review

A MAN jailed for shaking his seven-month-old daughter to death has had his case referred to the High Court over a possible miscarriage of justice.

Faisal Younas, then 35, was sentenced to six years in prison in 2008 for the culpable homicide of his daughter at the family home in Glasgow’s ­Pollokshields.

Alishba died from a brain injury at the Royal Hospital for Sick Children, Glasgow, in September 2005.

The child’s mother, Banu Younas, 35, was not in court to hear the sentence. When told of the jail term she said: “I will never believe my husband did this to our baby. He was a caring, loving, gentle father.”

Younas, a property developer from Lahore, Pakistan, came to Scotland seeking political asylum in 2001.

The jury heard how he burst into his GP’s surgery two days before the death of his daughter and demanded the doctor treat Alishba, who was having breathing difficulties. She was taken to the Victoria Infirmary and then to the Royal Hospital for Sick Children.

In 2011, Younas appealed his conviction claiming there had been a miscarriage of justice. It was rejected by judges in ­Edinburgh.

The Scottish Criminal Cases Review Commission said it had decided to refer Younas’s case to the High Court.
