Man asleep in driver’s seat was over limit

A MOTORIST was found slumped in his car outside a nightclub with his seat belt on and the engine running.

Police wakened Wayne Anderson after being called by a taxi driver who saw him asleep in the driver’s seat.

When officers opened the door of Anderson’s Nissan Micra he appeared to be “heavily intoxicated”, Livingston Sheriff Court was told yesterday.

A breath test showed his alcohol count was 86mg – more than twice the permitted 35mg drink-drive limit.

Anderson, 24, of West Calder, West Lothian, pleaded guilty to being drunk in charge of a car. He was arrested outside Club Earth in Livingston at 4.30am on November 3.

Gerry Bann, defending, said Anderson had had an argument with his partner and had driven to the nightclub only to find he was too late to be admitted.

Mr Bann said: “He went back to his car where he drank what’s accepted was a significant amount of alcohol and fell asleep. It’s a mark of Mr Anderson’s candour that he’s accepted his guilt.”

Anderson was fined £400 and banned from driving for eight months.
