Mitchell wins right to appeal
TEENAGE killer Luke Mitchell will appeal against his conviction on the basis that the trial should not have been held in the Capital.
The 17-year-old's defence team has always argued that the publicity the case generated harmed his chances when it came to trial.
Mitchell was convicted last year of murdering his girlfriend Jodi Jones, 14, in 2003. Her throat was slit and her body was mutilated.
Mitchell's lawyers lodged 14 grounds for appeal, but eight were thrown out by court judges.
They appealed that decision and today at the Court of Appeal in Edinburgh it was agreed one of the rejected grounds, that the case should not have been held in Edinburgh, should stand.
It is understood Mitchell's lawyers also plan to use new DNA evidence in their bid to overturn his conviction and minimum 20-year sentence.
