Cadder ruling offers rapist the possibility of a second hearing
A CONVICTED rapist is to have his case referred to the High Court following a controversial ruling on the rights of suspects to legal representation.
Ryan McCallum was sentenced to five years in prison after he was convicted of rape at the High Court in Glasgow in May 2009. But the Scottish Criminal Cases Review Commission said it has referred the case to the High Court because he “may not have had a fair trial”.
The body said the decision informed by the Cadder ruling. As a result of this ruling, cases where the Crown relied on a Cadder-affected interview for corroboration could not continue.
