British Home Stores was today cleared of allegations that it broke the law and allowed a pensioner to fall down a manhole at it’s flagship Princes Street store.

The store chain was taken to court over claims that staff at the shop didn’t follow health and safety legislation.

Prosecution lawyers at the city’s sheriff court claimed that workers didn’t follow the law and keep shoppers safe.

The crown claimed that negligence on the part of BHS staff caused Mollie McGregor,77, to fall down a manhole and injure herself at the shop in January 2009.

The company was brought to court to stand trial on two charges of breaking health and safety regulations.

But Sheriff Neil McKinnon told lawyers acting for BHS that there was no evidence to prove they were guilty of doing anything wrong.

Sheriff McKinnon added: “The most appropriate verdict is not guilty.”
