Aberdeen University student gets 7 years for drunken rape
A STUDENT who took a drunk woman home and raped her has been jailed for seven years.
Amit Gupta, 28, met the woman staggering in the street after a night out just before Christmas 2010, and claimed that she consented to sex but a jury convicted him of repeatedly raping her.
A judge told Gupta, who was studying business administration at Aberdeen University, that there were indications from background reports that “this was not the first occasion you had taken a drunk girl back to your flat to have sexual intercourse”.
Lord Tyre said: “You took advantage of a girl who was too drunk to give her free agreement to sex. Her anguish and distress as a consequence of this traumatic incident were only too obvious.
“I find it of considerable concern that even now, having heard your victim giving evidence at your trial, you seem unable to accept how wrong your actions were that night.”
Lord Tyre recommended that Gupta, an Indian, of Langstane Place, Aberdeen, be deported at the end of his sentence.
The defence counsel, David Moggach, said Gupta, a first offender, had been a law-abiding citizen since arriving in Aberdeen to study.
“His family took a loan to enable him to do that on the understanding that when he graduated, he would be able to seek better employment.”
