Girl tells court male classmate raped her twice at school

A teenage schoolgirl broke down in tears today as she told how a male classmate dragged her in a school toilet and raped her twice.

She claimed her attacker threatened her if she didn’t perform a sex act he would tell the school that she was “a dirty”, school slang for a “slag”.

Initially she agreed but after a few seconds said she didn’t want to continue. Despite her refusal she said she was roughly pushed to the floor, pinned down, and raped.

Her alleged ordeal lasted nearly half an hour later and only ended when the school bell rang.

She said: “I kind of froze and, as the bell went, the numbness went. I kind of kicked him off me.”

The 15-year-old pupil, who can’t be named for legal reasons, was aged just 13 and in second year at an Edinburgh high school, when the alleged attack took place in February 2011.

Resistance

The accused, from Edinburgh was also aged 13 at the time and cannot be identified.

He denies raping the girl twice during the alleged incident and has lodged a special defence of consent.

On the first day of a jury trial at the High Court in Livingston, the girl described her alleged attacker as “very cheeky”.

She said he had approached her in the home economics class on the morning of the alleged rapes and asked her if she would perform a sex act.

After class he followed her and grabbed her arm and took her into a disabled toilet despite her resistance.

CCTV footage shown to the jury appears to show her resisting being dragged into the toilet by her alleged attacker.

Further CCTV footage showed the girl leaving the disabled toilet, followed a minute later by the accused.

She then turns down a corridor and reappeared a few seconds later heading in the opposite direction.

She said: “I remembered I had biology. I was just confused.”
