Scottish independence: Date set for hearing on whether Scottish Government received legal advice on referendum

A COURT hearing over the Scottish Government’s refusal to disclose whether it has received legal advice on the status of an independent Scotland in Europe has been set for 18 and 19 December.

The dates for the clash between Holyrood and Scotland’s information commissioner, Rosemary Agnew, were announced at the Court of Session in Edinburgh.

Although the hearing has been put on to a fast-track procedure in the court, it is likely the three appeal judges will want time to consider their ruling after hearing submissions from both sides, and it will not be delivered until the new year.

Ms Agnew has said that under freedom of information legislation, the government should reveal whether it has received legal advice.

However, the First Minister, Alex Salmond, has insisted that disclosure would break the ministerial code.
