Perhaps contributors to the minorities’ rights debate could agree about one thing, namely the irony that our anti-discrimination legislation has created the necessity for the courts to exercise discrimination.

The pursuit of an illusory equality has resulted in real inequalities, the rights of some people having been compensated at the expense of others’ supposedly equal rights. In this the law has enhanced its reputation for sometimes being an ass.

Meanwhile, the insistence that one’s own rights should take precedence over another person’s rights – in the name of equality – remains one of the less attractive characteristics of human nature.
