Killer's mother denies plot to frame uncle
THE mother of a killer has denied that her son plotted a scheme from prison to frame the uncle of his children.
Kim Bain, the mother of the Marmion Pub gunman Jamie, said he did not organise a plot to bring assault charges against Adam Hendry Jnr. Adam – the brother of Jamie's former girlfriend – is facing charges over an alleged assault on James Bain, Kim Bain and Caroline Bain.
But at his trial at Edinburgh Sheriff Court yesterday the 24-year-old's solicitor, Vincent Belmonte, put it to Kim Bain that her son had orchestrated a web of lies from jail after becoming enraged at not being allowed to see his children.
Mrs Bain, 42, admitted Jamie was angry that the grandparents and guardians of his two children, Adam and Mary Hendry, had stopped the children from visiting him in prison. But, she said, he had not wanted any charges brought against their son, Adam Jnr, following the alleged attack and had urged his parents not to go to the police.
Mr Belmonte said: "Your son was making threatening phone calls from prison to people because he was not getting access, wasn't he? You all got together, organised by him, and committed the crime of perjury. Everything you said today was a complete lie, wasn't it?"
But Mrs Bain said: "He did not want us to report this to the police and he does not want to come to court. He did not want us to involve the police."
Mr Belmonte had earlier asked whether Adam Jnr had been a barrier to the Bains seeing their grandchildren and if the allegations against him were a plot to remove that barrier. Mrs Bain denied that was the case. The court heard from James and Kim Bain as well as their daughter Caroline, that Adam Jnr had attacked them at a friend's home.
It is claimed that after slashing James Bain's throat, Adam Jnr turned on his wife, kicking her twice to the face and bursting her nose before grabbing her leg and threatening to break it. Adam Jnr is also accused of punching their daughter Caroline in the face "once or twice" before being locked out of the house.
Adam Jnr is charged with slashing James Bain's throat and kicking him in the head to his permanent disfigurement and danger of life during an alleged attack at an address in the Gilmerton area of Edinburgh in July. He faces further charges of assaulting Kim and Caroline Bain.
Jamie Bain, now 24, shot Alex McKinnon, 32, in the Marmion bar in Edinburgh in 2006. He was jailed for 22 years for the attack.
