Plans for no-fault compensation announced

PATIENTS who are victims of negligence might be able to claim compensation in future without having to go through lengthy proceedings.

Under a plan published by the Scottish Government, a system could be introduced that would neither require a victim to prove legal responsibility, nor prove that clinical negligence took place.

Health secretary Nicola Sturgeon launched the idea following consultation on a patients' rights bill.

The news has been welcomed by the chairman of the British Medical Association (BMA) in Scotland, Dr Peter Terry, who said: "BMA Scotland has long favoured the introduction of no-fault compensation as a less adversarial system of providing appropriate and timely compensation and support to those who suffer personal injury through medical mishap."
