Leukaemia case sent back

A LONG-RUNNING battle over whether childhood leukaemia figures should be made public was yesterday sent back to the Scottish Information Commissioner.

The House of Lords concluded the case should be remitted to the commissioner, Kevin Dunion. Three years ago, he ruled the information should be released – albeit in a "suitably amended" form to reduce the risk of identifying individuals.

The case was sparked by a Freedom of Information request in 2005

for yearly information on childhood leukaemia cases in boys and girls up to the age of 14 in Dumfries and Galloway between 1990 and 2003.

NHS National Services appealed and took the matter to the Court of Session.
