'Every abuse victim needs a say'

CHILD abuse survivors should have the right to redress through a proposed forum on historical cases, a human rights leader said yesterday.

Professor Alan Miller, chairman of the Scottish Human Rights Commission, said this could take the form of an apology, access to justice or psychological support.

He was speaking as he welcomed the results of a consultation into a "truth and reconciliation" body announced by the Scottish Government.

The publication – which was supported by survivors – will acknowledge crimes against young people in Scottish residential homes.

But some respondents said any apologies may be forced or empty.

Professor Miller said he will help inform the design and operation of the proposed forum, putting human rights at "the heart" of the process.

"Every victim of a human rights violation – obviously including the adult survivors of cruel, inhuman and degrading treatment or punishment in Scotland's care homes, residential schools and institutions – has the right to an effective remedy, whether that is an apology, access to justice or psychological support," Prof Miller added.

The government announced a plan in February last year for the body, which will allow people abused in residential homes to present their experiences.

Responses to the consultation showed "unanimous" support, reflecting a "strong desire" for experiences to be heard.

Keeping a historical record of abuse, which could be anonymous, had support.

The "vast majority" said acknowledgement was important but offered mixed responses to calls for apologies.
