Cyclist must pay after losing accident case
A CYCLIST who raised a court action against a motorist seeking payment for injury and damage to his bike has lost his case.
Instead, he must pay the motorist expenses after a Sheriff ruled he had fabricated his story to get money.
At Edinburgh Sheriff Court, 27-year old Duncan Cameron of Ferry Road, Edinburgh, claimed 21-year old Christopher Wallace had knocked him off his bike in Ferry Road, on July 15, 2009, and driven off with the cycle under his car. But Mr Wallace, of Langton Road, East Calder, said he had carried out an emergency stop before the cyclist opened the driver's door and began verbally abusing him. Mr Wallace said, fearing for his safety, he had driven off with the cycle underneath. He then saw Mr Wallace and other youths running after him. In her judgement, Sheriff Kathrine Mackie said she did not find Mr Cameron's version of events "credible".
