Man accused of rape claims that sex was ‘consensual’
A MAN accused of rape has claimed that his alleged victim consented to sex.
Kazim Kadiri told a jury that the door was ajar and the light on when he went to her bedroom in the middle of the night.
He said he found the 29-year-old woman sitting up in bed awake with a duvet pulled up to her neck and said “hi”.
Then he sat on the bed and chatted to her, claiming she told him her ex-boyfriend had cheated on her. He said they kissed before she agreed to have sex with him. Kadiri, 38, was giving evidence in his own defence at the High Court in Livingston yesterday.
Kadiri denies raping the woman in a house in Livingston, West Lothian, on November 7, 2010.
The charge alleges that he carried out the sex attack while the woman was asleep, under the influence of alcohol and “incapable of giving or withholding her consent”.
The jury is expected to reach a verdict today.
