Married man cleared of sex attack on woman in Craigmillar

A MARRIED man has been cleared of raping a woman he met through an online dating agency.

A jury at The High Court in Livingston took just 33 minutes to return a majority verdict finding David Evans not proven.

Evans, 34, from Edinburgh, used the screen-name “Ebony” to lure a 26-year-old who was looking for love on the Plenty of Fish website.

The father-of-one exchanged messages on the site with the mum then befriended her on Facebook.

When she gave him her mobile phone number they exchanged text messages which became increasingly flirtatious.

The night before they arranged to meet, she sent him a text saying: “You can hug me all night tomorrow.”

The jury heard that the woman – who can’t be named for legal reasons – picked him up in the West End and took him home to her flat in Craigmillar.

She consented to intercourse and they fell asleep, before Evans wakened her in the middle of the night and said he wanted more sex.

Although the woman claimed that he pinned her down and raped her, the jury believed his story that she had consented.

Unemployed Evans – who is originally from Ghana in West Africa – had denied raping the young mum in her home on May 1, 2011.

He claimed she had lost her temper and cried rape because he accidentally urinated in her bed.
