Obama chooses Hispanic woman for top court

BARACK Obama yesterday put flesh on the bones of his promise to make America's governance more inclusive by nominating a Hispanic judge, Sonia Sotomayor, to fill a vacancy on the Supreme Court.
Ms Sotomayor, born to poor immigrants from Puerto Rico in New York, would be the first Hispanic ever to serve on America's top legal body and only the third woman to hold the position if her nomination is confirmed by the Senate.

bed her as "an inspiring woman who I believe will make a great justice".

Ms Sotomayor, 54, said: "I am an ordinary person who has been blessed with extraordinary opportunities and experiences."

Tough confirmation hearings were predicted yesterday, with Republican senators likely to focus on a statement she made back in 2000 that the sex and ethnic origins of a judge "may and will make a difference in our judging".

In her statement, during a confirmation hearing as an appeals judge, she said: "I would hope that a wise Latina woman with the richness of her experiences would more often than not reach a better conclusion than a white male who hasn't lived that life."

For some critics, this statement, along with previous declarations by her that judges "make policy" indicate that she sees her role as political rather than strictly judicial.

"Judge Sotomayor is a liberal judicial activist of the first order who thinks her own personal political agenda is more important than the law as written," said Wendy Long, counsel to the Judicial Confirmation Network. "She thinks that judges should dictate policy".

Senate minority leader Mitch McConnell said the Republicans "will thoroughly examine her record to ensure she understands that the role of a jurist in our democracy is to apply the law evenhandedly, despite their own feelings or personal or political preferences".

Supporters say Ms Sotomayor will bring a much-needed new perspective to an institution traditionally dominated by white male justices.

"Its an important step for the United States," said Princeton law professor Sherrilyn Ifill. "She's bringing something to the court."

They also point to her background as a rags-to-riches story that will affirm the ability of ordinary Americans to rise to the top.

Born in New York's Bronx, her father died when she was nine, a year after she was diagnosed as diabetic.

But her mother took two jobs to raise the money to pay for her education, and Ms Sotomayor secured places in Princeton University and later Yale Law School.

She worked as a prosecutor in New York before becoming a judge and later an appeals judge on the Second Circuit, covering New York and neighbouring states.

Mr Obama highlighted the fact that she would be the only member of the Supreme Court to have had experience as a trial lawyer.

However, her appointment will not change the political balance of the court, which is conservative, as she replaces another liberal, Judge David Souter, leaving the court with five conservatives and four liberals.

More intriguing is that she would bring to six the number of Catholics serving on the court, along with two Jewish members and one Protestant, possibly impacting on decisions on issues including abortion and gay marriage.

Rags to riches, in America that dream can come true and I applaude her. However, being hispanic, Catholic and anything else like that is illreverlant. What the average American wants is an honest judge that will decide issues on the Constitution as worded. Not their political leanings. We don't want one that will rewrite the Constitution, make exceptions or anything else. The Constitution is written in simple and plain English.

I would agree with woodchopper in #1 when he says we should respect the constitution, except for 1 thing - the constitution is not respected today and has not been for a long time.

whoever asserts that the SCOTUS bench represents the mix of America is flat wrong.

America is more than 50% protestant but there is only one protestant WASP - Justice Stevens. He's also the oldest.
SO when he retires, will the President nominate a WASP? Doubtful.

it looks like we're going to have a Catholic Bench, which is pretty odd considering there are few Catholics in Congress and we're not a "Catholic country"

"One case that is sure to come up in any confirmation hearing is one that deeply divided the circuit, Ricci v. DeStefano, 06-4996-cv, a reverse discrimination case that was argued last month in the U.S. Supreme Court.

Judge Sotomayor was on the panel that upheld the dismissal of a case brought by white firefighters and one Hispanic firefighter from New Haven, Conn. who challenged the city's decision not to certify the results of exams administered in 2003 because minority applicants performed less well on the tests. The city feared Title VII liability if more minorities were not promoted into the upper ranks of the department and the test results were not helpful."


This ruling against the firemen, and for affirmative action, is going to be a bucket of trouble for her in the nomination process

The case you mention is troubling, but I really don't know the specifics about the actual test to be able to form a valid opinion. Also, I have seen nothing anywhere that says conclusively that Sotomayor agreed with the two other judges on that. She was certainly on the panel of three judges, but they don't have to be unanimous.

I see no reason for concern regarding illegal aliens. Just because she herself is Hispanic does not mean that she agrees that it's fine and dandy for people to come here illegally. In fact, a majority of Hispanics who are here legally, either because they are citizens or with green cards, are not sympathetic to the cause of the illegals.

#18, her ethnic heritage is Hispanic, her parents came to New York from Puerto Rico. She has been a judge in New York State for 17 years, so why don't you figure out for yourself whether or not she speaks English?

WL in #18 - We have many people in our country who have hispanic or spanish surnames and yet they normally speak english and do not speak spanish at all. And yet there is a move on to force people to speak spanish. its insane. Remember, back in 1848 we got a lot of land that had about 5% of the mexican population on it. And that 5% of mexican population became American. But we sometimes called them 'mexican' as an ethnic identity even though we understood that they were American. These people generally learned to speak english though it may have taken generations after 1848 for that to happen. Just like germans came here and spoke german for 2, 3 or 4 generations but eventually switched to english. Of the many hispanic or spanish language immigrants we've absorbed for many decades they overwhelmingly have learned to speak english. Normally their children become english-only speakers.

but recently some of the immigrants have been wanting to speak spanish instead of english. and there are so many of them that they're able to. To complicate matters we have a sort of a communist way about us where many corporations, many local governments and school systems are forcing people to speak both languages. In schools little children of hispanic and non-hispanic backgrounds who normally speak english only are being forced to speak spanish. I'm not joking. and many corporations won't hire you unless you speak both languages. Children in schools are indoctrinated to think they must speak both languages. Local governments are forcing their employees to speak both languages, literally firing people who won't learn spanish. There are now many jobs where you must speak spanish or else don't apply. Generally the immigrants speak both languages, they are given a huge advantage. I have listened to several young people under 20 who were born here, but born to mexican immigrant parents and they complain that they are forced to speak spanish when they don't even know

The term 'hispanic' is an American term. It was popularized by the US government. Outside of our country the term is not generally used. For the people of latin America whether they be of mexico, central america or south america the term 'hispanic' is considered an American term, not a word they use to describe themselves. The US government made that term to describe immigrants to our country who were from Mexico, carribean, central america or south america. There is huge racial variety in that region in that you have whites, you have blacks, you have natives and you have people who are mixtures. You have people of japanese or even chinese ethnic background living in peru or brazil. You have germans living in brazil too. and I mean people who were born in brazil but are ethnic german. Belize, Bermuda and others in the Carribean speak english as their language, yet they are considered 'hispanic' by the government.

So the term hispanic is an American word. Outside of our country people don't speak that way and are confused by that word.

Here's something interesting as a follow-up to #29. We used to use a term of 'black-irish' to describe some people. This term is no longer used as we no longer have any black-irish around. But these were people who were mixtures between black and irish. They spoke english with a very strong Irish accent. They were Irish from a cultural point of view, they preserved that culture for generations. But they were mixtures with black africans, so they appeared to be black.

The English enslaved many Irish and mixed them on plantations in the Carribean with black african slaves. There were Irish slaves and they ended up getting mixed with blacks. Remember, in America black people are really half white. In the Carribean the blacks are more black. But we had some black irish here in America.
